Community Benefits Agreement Provisions

All construction contracts valued at $1,000,000 or more within the San Diego Community College District (SDCCD) are subject to the District’s Community Benefits Agreement (CBA). Contractors submitting bids meeting this criteria must comply with the provisions outlined in the CBA, which can be accessed here: Community Benefits Agreement (Signed)

Contractors submitting bids must adhere to the following requirements outlined in the CBA:

1. Initial Employment Preference
Contractors shall prioritize hiring individuals meeting the following criteria:

  • Residents of qualifying ZIP codes designated in the CBA.
  • Veterans residing anywhere within San Diego County.

2. Craft Hour Allocation:
At least 80% of all craft hours must be performed by individuals who fall under one or more of the following categories:

  • Residents of San Diego County.
  • Dependents of active-duty military personnel.
  • Current or former students of SDCCD, including:
    - Former foster youth.
    - Formerly incarcerated individuals.

3. Support for Apprentice and Academic Programs
Contractors are required to work in partnership with SDCCD apprentice programs and related academic programs to provide training and development opportunities. This includes outreach to program coordinators to ensure student opportunities. 

Bid Submission Requirements

Bidders must include the following in their proposal:
1. Local Hiring and Workforce Development Plan:

  • A detailed strategy outlining how the contractor will meet the 80% craft hour requirement.
  • A plan for outreach to residents of qualifying ZIP codes, veterans, and SDCCD students.

2. Apprentice Program Participation Plan:

  • A commitment letter or memorandum of understanding (MOU) with SDCCD apprentice and academic programs.
  • Evidence of engagement with SDCCD to align construction activities with apprenticeship opportunities.

3. Compliance Reporting Plan:

  • A system for tracking and documenting workforce demographics to ensure compliance with CBA requirements.
  • Regular reporting schedules and milestones for submitting workforce data to SDCCD.

4. Community Engagement and Training Initiatives

A description of initiatives to support the professional growth of individuals from underrepresented or disadvantaged groups, such as former foster youth and formerly incarcerated individuals.

Contract Terms and Conditions

1. Adherence to CBA:

  • Contractors are required to comply with all provisions of the SDCCD Community Benefits Agreement
  • Non-compliance with the CBA may result in penalties, termination of the contract, or disqualification from future bidding opportunities.

2. Reporting and Audits:

  • Contractors shall submit periodic reports on workforce composition, local hiring outcomes, and apprenticeship engagement.
  • The District reserves the right to audit contractor records to ensure compliance with CBA requirements.

3. Contractor Responsibilities:

  • Proactively coordinate with SDCCD to facilitate workforce training and apprenticeship integration.
  • Ensure that subcontractors are informed of and comply with CBA provisions.

Determination of Responsiveness and Responsibility

To be deemed responsive and responsible regarding CBA requirements, bidders must:

  1. Demonstrate compliance with the CBA requirements as outlined in the bid documents.
    Submit all required plans and documentation, including the Local Hiring and Workforce Development Plan, Apprentice Program Participation Plan, and Compliance Reporting Plan.
  2. Agree to adhere to all terms and conditions specified in the CBA and contract documents.
  3. Failure to comply with these requirements may result in a determination that the bidder is non-responsive or non-responsible, and the bid may be rejected.
